In Texas, parental rights are addressed through the legal concept of conservatorship. When a married couple has a child, both parents are, by default, joint managing conservators over the child. The following are a few of the complications that can arise with respect to parental rights:
- Divorce: When a child´s parents get divorced, the child must either be placed in a joint managing conservatorship based on a shared parenting plan or a sole conservatorship under one parent´s primary custody and control. This issue can be resolved through negotiations or litigation.
- Unmarried parents: When a child is born outside of marriage, his or her father does not have any parental rights or responsibilities until both parents formally acknowledge paternity or the child´s father is identified by the courts through a paternity action.
- Grandparents´ rights: In Texas, grandparents normally have very limited rights with respect to their grandchildren. However, when a child´s parents are unable to provide appropriate care and support, grandparents may be able to obtain conservatorship rights.
- Stepparents´ rights: Stepparents do not normally have any parental rights over their stepchildren. However, when one of a child´s birth parents is unfit or otherwise out of the picture, the other parent´s spouse may be able to obtain parental rights through adoption.
