  • Collaborative law: In a collaborative divorce, each spouse is represented by a lawyer, but both the parties and the lawyers agree upfront that they will not take the case to trial. If the process breaks down and litigation becomes necessary, both parties need to hire new attorneys. This process keeps everyone focused on avoiding a court battle.
  • Mediation: In divorce mediation, both spouses meet with a neutral mediator who helps them pursue a negotiated settlement. Depending on the type of mediation, the parties´ lawyers may or may not be present. In certain situations, the courts may require mediation, and in other cases, it is available as an alternative dispute resolution option.
